He sued and was awarded $1.7 million by an Oklahoma Federal court. Quite a comment on the absurdity of the legal system! Obviously we need serious tort reform.
This case is one of the “Stella” awards that purport to show how undeserving people, and their lawyers get rich off frivolous lawsuits. The list circulates on e-mails and over the internet and is named for the woman who spilled McDonald’s coffee in her lap causing third degree burns.
Only one problem: It never happened.
A search of the Western District Court, where the case was supposedly filed has failed to turn up anyone by that name. No such case against Winnebago has ever been found.
So don’t believe everything those who want to limit the recovery of injured plaintiffs tell you.
The tort system isn’t perfect, but most of the time jurors who hear the evidence get it right. Unless they get very angry like the jury in Layne. Poor Dr. Galway.
